Terms of Service

Acceptance of terms
By creating an account or using the JobGhost service ("Service") you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.
Description of service
JobGhost is a software-as-a-service platform that helps recruiters and hiring managers automate candidate communication. The Service may send templated status updates to candidates based on configurable rules and timing. Features available to you depend on your subscription plan.
Accounts and eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@jobghost.ai if you suspect unauthorised access.
You may not share your account with others or create accounts through automated means.
Acceptable use
You agree not to:
- Use the Service to send spam, unsolicited commercial email, or deceptive messages.
- Violate any applicable law, including anti-spam laws and data protection regulations.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell or sublicense access to the Service without our written consent.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Upload or transmit malicious code.
We reserve the right to suspend or terminate accounts that violate these rules.
Subscription and billing
The Service is provided on a subscription basis. Current pricing and any trial offers are available on the Pricing page.
Subscriptions renew automatically unless cancelled. You authorise us to charge your payment method on file for each renewal period. You may cancel at any time from your account settings; access continues until the end of the current billing period.
We reserve the right to change pricing with reasonable notice to existing subscribers. We will work with you in good faith where billing errors occur.
Your data
You retain ownership of your data. By using the Service you grant JobGhost a limited licence to process your data solely to provide the Service to you.
You are responsible for ensuring that any candidate data you process through JobGhost complies with applicable privacy and data protection laws. This includes having a lawful basis for processing candidate personal data and providing appropriate notices where required.
Where the Service integrates with third-party email or calendar providers, access is granted via authorisation flows provided by those platforms. You can revoke that access at any time through the relevant provider's settings.
Intellectual property
The Service, including all software, design, and content created by JobGhost, is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. The "JobGhost" and "Nia" names and marks belong to JobGhost.
Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, JobGhost will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities.
Our total aggregate liability to you in any 12-month period will not exceed the amounts you paid to us for the Service in that period.
Termination
You may stop using the Service and cancel your subscription at any time.
We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice where practicable.
On termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. When we make material changes we will notify you by email or via a prominent notice in the app before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Service will be handled in accordance with applicable legal requirements.
